Applicability & Legislation:

The present General Terms and Conditions of Sale (hereinafter referred to as “G.T.C.”) of La Grourerie® comply with the provisions of the Consumer Code and govern all transactions carried out under French legislation on distance selling on the website www.lagrourerie.com.

Transparency & Commitment:

They aim to ensure clarity and understanding of the consumer’s rights and obligations.

Accessible Legal References:

La Grourerie®, a company established in France, complies with French legislation. As such, the legal references provided are in French.

For greater clarity, clickable references to legislative articles from the Consumer Code are available on Légifrance.

Access & Archiving:

The G.T.C. will be annexed to the invoice transmitted to ensure their accessibility and long-term conservation.

Contractual Framework:

These G.T.C., along with the order summary, constitute a unique contractual framework governing the entire relationship between both parties. In case of any discrepancies between these documents, the G.T.C. shall prevail.

Modification & Consultation:

The G.T.C. may be printed or saved but cannot, under any circumstances, be modified.

Article 1 – Purpose:

The present General Terms and Conditions of Sale (hereinafter referred to as the “G.T.C.”) govern the online sale of Moroccan cosmetic and wellness products (hereinafter referred to as “Products”) offered on the website www.lagrourerie.com (hereinafter the “Website“), operated by La Grourerie® and managed by the company G. & L. Corp..

These terms define the conditions for remote sales between La Grourerie®, on one hand, and any individual consumer of legal age or minor with parental authorization, on the other hand (hereinafter referred to as the “Buyer or User”).

They establish the contractual relationship and the applicable conditions for any order placed on the Website.
The G.T.C. in force at the time of order validation shall apply and cannot be modified retroactively.

1.1 – Eligible Customers:

Purchases are reserved for private individuals, non-traders, of legal age or minors under the responsibility of a legal guardian.

1.2 – Acceptance of G.T.C.:

Before placing any order, the Buyer must read and accept the G.T.C. by checking the box “I accept the G.T.C.” or an equivalent mention.
This validation formalizes the contractual commitment between the Buyer and La Grourerie®.

1.3 – Changes to G.T.C.:

The present G.T.C. may be updated by La Grourerie® at any time. A notification or banner will be displayed to inform visitors and Buyers.
Any new order placed after an update implies acceptance of the new conditions.

Article 3 – Website Operation and Access:

3.1 – Website Operation:

La Grourerie® strives to ensure continuous access to the Website 24/7. However, uninterrupted availability cannot be guaranteed. Certain circumstances may lead to temporary unavailability of the Website, including:

  • Technical maintenance operations,
  • Updates and improvements,
  • Events beyond our control (network incidents, server overloads, cyberattacks, etc.)

La Grourerie® reserves the right to modify or remove any content from the Website at any time, without prior notice, in order to enhance user experience or comply with operational and legal requirements.

3.2 – Website Access:

The Website is secured using the “HTTPS” protocol, ensuring the authenticity and integrity of data exchanges.
While browsing, a padlock icon should appear in your browser’s address bar, confirming the security of your connection.

Users are responsible for having the necessary technical means to access the Website (internet connection, compatible device, etc.).

La Grourerie® cannot be held responsible for any issues related to the User’s connection or hardware.

Orders are placed exclusively online through the Website, and the available products displayed correspond to the stock at the time of consultation.

Article 4 – Products:

4.1 – Description & Characteristics:

The Products available on the Website are described with the highest level of accuracy (origin, description, characteristics, composition, price, product image…), ensuring that the Buyer/User has access to comprehensive product descriptions.

However, minor variations may exist between the actual Product and its online presentation, without engaging La Grourerie®’s liability.

We recommend that the Buyer carefully read the product descriptions to understand their properties and uses before placing an order.

4.2 – Product Availability:

Products are offered while stocks last. If a Product becomes unavailable after order validation, the Buyer will be promptly informed by customer service and may choose between:

  • Replacement with an equivalent Product, or
  • Refund of the order within 14 days.

If a Product becomes unavailable after the order has been placed and the Buyer indicates that they do not wish to receive an equivalent Product, customer service will proceed with a refund within 14 days.

La Grourerie® reserves the right to withdraw any Product from sale at any time or to modify its description without prior notice. La Grourerie® shall not be held liable to the Buyer or any third party for any consequences arising from the removal of a Product from the Website or from the replacement or modification of any content or information displayed on the Website.

4.3 – Usage Instructions:

Our Products are natural and organic and may be handled or mixed by the Buyer. However, it is essential to adhere to:

  • The usage precautions,
  • The recommendations provided,
  • The instructions included with each order.

La Grourerie® systematically includes usage instructions with every order. The Buyer must review these guidelines before any use and strictly comply with them.

If usage precautions are missing from an order, please contact our customer service immediately to receive an updated version of the instructions.

La Grourerie® disclaims any liability for improper use, misuse, or failure to follow the usage guidelines.

4.4 – Resale, Commercial Use & Regulations:

La Grourerie® offers ingredients and cosmetic Products on its Website intended for private individuals for personal use or DIY (“do-it-yourself”) preparations.

La Grourerie® reminds its customers that the commercialization of cosmetic products is strictly regulated by specific laws.

Any resale of a Product is therefore subject, in addition to the contractual provisions between the Buyer and La Grourerie®, to the applicable legal and regulatory requirements.

Any use of the Products by the Buyer for transformation, commercialization, or placing them on the market exonerates La Grourerie® from all liability.

The resale of La Grourerie® Products is strictly regulated.

It is only permitted under a specific written contract concluded between La Grourerie® and the Buyer/Reseller.

Without this contract, any resale or commercial exploitation of our Products, whether used as-is or incorporated into a more complex preparation, is strictly prohibited.

The repackaging of La Grourerie® Products under another brand is also prohibited, except with prior, explicit, and written authorization.

Article 5 – Prices:

5.1 – Pricing & VAT:

La Grourerie® reserves the right to modify its prices at any time. However, the prices in effect at the time of the order are guaranteed, subject to stock availability.

The prices displayed on the Website are guaranteed on the date of the order, subject to stock availability, except in cases of obvious pricing errors or omissions.

The prices of the products are listed in euros (€) and are valid for the territories of the European Union, excluding overseas territories (DOM-TOM). Product prices are listed inclusive of all taxes (TTC) and include the applicable Value Added Tax (VAT) for European Union countries.

5.2 – Shipments Outside the European Union:

As part of its launch, La Grourerie® temporarily limits its shipments to certain European Union countries. This list will gradually expand to allow for international distribution.

Shipping conditions for countries outside the EU are as follows:

  • Billing is exclusive of VAT.
  • Potential customs duties and additional fees may be applied by local authorities.
  • These fees remain the sole responsibility of the Buyer.

We are actively working on adding new destinations and remain committed to expanding our logistics network.

It is the Buyer’s responsibility to verify the compliance of the Products with the regulations of their country before purchasing.

The products marketed by La Grourerie® comply with French regulations.

5.3 – Shipping Fees:

Shipping fees are automatically calculated based on the Buyer’s entered address, taking into account:

  • The order amount (Free Shipping Threshold),
  • The total weight of the order,
  • The destination,
  • The shipping method selected by the Buyer.

For some orders exceeding a specified threshold, shipping fees may be waived.

This threshold may be modified by La Grourerie® and will be specified on the Website via a banner or notification.

Shipping fees do not include potential import taxes, customs duties, or additional fees required upon entry into certain countries.

5.4 – Promotional Offers:

Offers and promotions displayed on the Website are valid while stocks last and for the specified duration.

Use of Promotional Codes:

  • Must be entered before order validation.
  • Cannot be combined with other promotional codes.
  • If applying a promotional code reduces the order amount below the free shipping threshold, shipping fees will apply.

5.5 – Loyalty Program:

La Grourerie® is developing a loyalty program designed to reward its regular customers. This program, currently under development, will allow customers to benefit from specific advantages and rewards tailored to their level of engagement.

The terms and conditions for accessing this program will be specified later and will be included in a dedicated section.

La Grourerie® is committed to creating a transparent and fair system that respects the principles set forth in these Terms & Conditions.

 

Article 6 – Creating a Customer Account:

Creating a La Grourerie® customer account (hereinafter referred to as the “Account”) is recommended for an optimal experience (order tracking, invoice access, loyalty benefits, etc.). However, it is not mandatory to place an order.

A valid email address is still required for order confirmation and tracking.

6.1 – Account Registration and Management:

When registering, the Buyer/User must provide accurate and complete information:

  • Identity: Title, First Name, Last Name,
  • Shipping Address: Full address + additional details (Building, Residence, Landmark, etc.)
  • Billing Address: Optional if different from the shipping address
  • Location Information: Postal Code, City, Country
  • Phone Number: Optional but recommended for tracking, delivery, and customer service
  • Email Address,
  • Newsletter Subscription: Optional (Loyalty & Product Updates)

Once the form is submitted, a confirmation email is sent.

The Buyer must keep their personal information up to date to ensure the proper processing of their orders.

If incorrect information is provided, La Grourerie® cannot be held responsible for a failed delivery.

6.2 – Customer Responsibilities:

By creating an account:

  • The Buyer certifies they are of legal age and have the legal capacity to enter into contracts.
  • They are responsible for the confidentiality of their credentials and agree not to share them.
  • They must keep their contact details up to date (address, email, phone number) to ensure the correct receipt of their orders.

La Grourerie® reserves the right to delete an Account at any time in case of non-compliance with the Terms & Conditions or for any other legitimate reason, without prior notice or compensation.

 

ARTICLE 7 – ORDER REGISTRATION AND VALIDATION:

7.1 – Placing an Order:

The order placement process on the La Grourerie® website follows these steps:

  • The User selects the desired Products and adds them to their cart.
  • They access their cart, can modify its contents, and then validate it.
  • They complete or confirm the necessary delivery details.
  • They accept the present General Terms and Conditions of Sale.
  • They choose the payment method and confirm the order.

The validation of the order through payment constitutes a definitive acceptance by the Buyer.

7.2 – Order Confirmation:

After payment validation, La Grourerie® sends a confirmation email including:

  • The confirmation of the order registration.
  • A summary of the ordered Products.
  • The total amount of the order.
  • The shipping costs.
  • The estimated delivery date or timeframe.
  • The Buyer’s personal information, including their shipping address.
  • Information on the right of withdrawal, in accordance with Article L221-18 and subsequent articles of the French Consumer Code.

This confirmation serves as formal proof of the sales contract between the Parties.

7.3 – Input Errors:

La Grourerie® cannot be held responsible for any input errors made by the Buyer.

Such errors may result in delays or additional costs, which will be borne exclusively by the Buyer.

If, after order validation, the Buyer notices an error in their information (address, name, contact details), they are invited to immediately contact Customer Service via our contact form before shipment to prevent any mistakes or losses.

 

ARTICLE 8 – PAYMENT TERMS:

8.1 – Payment Methods:

La Grourerie® reserves the right to add or remove payment methods without prior notice.

8.2 – Payment Validation:

Full payment is required to validate an order.

If a payment authorization is declined by accredited institutions or in case of non-payment, La Grourerie® reserves the right to suspend or cancel the order.

In such cases, we offer alternative solutions and other payment methods (see above “Payment Methods“) to facilitate the completion of your purchase.

8.3 – Payment Security:

All payments are processed through Stripe, a secure platform using SSL (Secure Socket Layer) encryption to protect transmitted information.

The best way to secure a payment is by using authentication and encryption protocols such as SSL.

This protocol ensures an encrypted session, preventing third parties from intercepting sensitive data transmitted over the network, such as credit card numbers during payment or passwords during user login on a website.

Banking details are not stored by La Grourerie®, nor are they accessible by its staff.

8.4 – Currency:

All transactions made on La Grourerie®’s website are processed in euros (€), ensuring transparency and uniform pricing for all customers.

For orders placed outside the European Union, please note that bank fees or conversion fees related to the local currency may be applied by the Client’s financial institution. These additional fees, independent of La Grourerie®, remain entirely the Client’s responsibility.

We strongly advise our international clients to check with their bank before finalizing their order to avoid unexpected charges related to foreign currency transactions.

 

ARTICLE 9 – DELIVERY :

9.1 – Delivery Methods and Timeframes:

La Grourerie® ensures the delivery of orders to the address provided by the Buyer at the time of purchase.
To cater to diverse needs and preferences, we collaborate with trusted partners, offering multiple delivery options:

Mondial Relay

Colissimo offers:

  • Delivery to home without signature (delivered to the mailbox, provided the parcel dimensions allow).
  • Delivery to home with signature for added security.
  • Delivery to a Pickup Point of the Buyer’s choice (post offices, partner businesses, etc.).

Mondial Relay offers:

  • Delivery to a Relay Point chosen by the Buyer, at partner businesses.
  • Delivery to secured Lockers (storage lockers with personal access codes).

La Grourerie® partners with reliable shipping providers to ensure the smooth transport and delivery of parcels under optimal conditions.

La Grourerie® places high importance on timely deliveries and shipment security. To optimize tracking and guarantee seamless shipping, each package benefits from a triple identification system.

Along with the shipping label indicating the delivery address, two additional labels are affixed to the parcel. These include key details such as the Buyer’s name, tracking number, postal code, destination country, and the La Grourerie® customer code assigned by our logistics partners.

Thanks to this additional precaution, in case of loss or damage to the main label, our partners can instantly reprint the necessary information to ensure the parcel reaches its final destination without delay or confusion.

However, incidents such as delays or package loss may occur.

If the customer service of our delivery partners confirms that the parcel has been delivered, La Grourerie® cannot be held responsible in the event of theft or disappearance. In such cases, it is up to the Buyer to report the incident to the relevant authorities and, if necessary, file a claim.

If delivery is delayed beyond 7 business days, the Buyer is invited to contact our customer service.
We work closely with postal services to initiate an investigation with the carrier.
This process may take up to 21 days.
If the parcel is declared lost, La Grourerie® will offer, depending on stock availability, either a replacement or a full refund of the order.

We also encourage the Buyer to check their mailbox promptly upon receiving a delivery notification to avoid any inconvenience.

9.2 – Estimated Delivery Times:

  • Metropolitan France: 3 to 5 business days.
  • International: 5 to 20 business days, depending on the destination country.

These timeframes are indicative and may vary based on logistical constraints or the carrier’s policies.

Once an order has been shipped, it can no longer be canceled.

9.3 – Delivery Costs:

Delivery fees are calculated based on the delivery method chosen by the Buyer and the destination country.
These costs will be clearly stated before the order confirmation.

Delivery charges do not include potential import taxes, customs duties, or local taxes for international shipments.
These additional costs remain the exclusive responsibility of the Customer.

9.4 – Delivery Address:

It is the Buyer’s responsibility to ensure the accuracy of the information provided at the time of order placement.
An incorrect or incomplete address may result in delays, additional charges, or the inability to deliver the products.
La Grourerie® cannot be held liable in case of any issue related to an incorrect address.

 


ARTICLE 10 – RIGHT OF WITHDRAWAL, RETURNS & REFUNDS:

10.1 – Withdrawal period and conditions:

In accordance with the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 and Law No. 2014-344 of 17 March 2014, transposed into Articles L.221-18 et seq. of the French Consumer Code, the Buyer has a right of withdrawal of fourteen (14) days from the receipt of their order.

  • The product must be returned in its original packaging, complete (including accessories and manuals).
  • It must be in perfect condition, unused, unopened, and undamaged.

The withdrawal period expires fourteen (14) days after the day the Buyer, or a third party other than the carrier and designated by the Buyer, takes physical possession of the Product(s).

Returns of Products that do not comply with these conditions or are made outside the mentioned deadlines will not be eligible for a refund. In such cases, the sale will be considered final.

10.2 – Return procedures:

To exercise their right of withdrawal, the Buyer must notify La Grourerie® of their decision via a clear and unambiguous declaration:

The return of Products must be made to the above address, accompanied by a return form (provided by La Grourerie®) or a handwritten document containing the following information:

  • Full name
  • Email address
  • Order number and date of purchase

Return shipping costs: Covered by the Buyer.

Loss or damage: La Grourerie® is not responsible for returned products that are damaged during transit.

10.3 – Refund process:

In accordance with Article L.221-24 of the French Consumer Code, La Grourerie® will process the refund within 14 days upon receiving and validating the returned products.

Refund covers:

  • The full payment if the entire order is returned.
  • A partial refund if only some Products are returned.

Refund method: Refunds will be issued via the original payment method used at checkout.

10.4 – Exclusions from the right of withdrawal:

Certain Products are exempt from the right of withdrawal under Article L.221-28 Paragraph 5 of the French Consumer Code:

  • Opened products that cannot be returned for hygiene reasons.

“Goods unsealed by the consumer after delivery and that cannot be returned for hygiene or health protection reasons.”

If in doubt, please contact our customer service before returning any product.

10.5 – Delayed delivery and cancellation rights:

If the delivery period exceeds 30 days, the Buyer may cancel their order and receive a full refund by submitting a request to customer service, as per Article L216-1 Paragraph 3 of the French Consumer Code.

The cancellation request must be submitted in writing via email or postal mail and will be processed within 24 hours.

10.6 – Return due to undelivered orders:

The Buyer is responsible for providing accurate and up-to-date delivery and billing information. If incorrect information is provided, La Grourerie® cannot be held liable.

Refunds will be processed minus the shipping fees incurred by La Grourerie® if:

  • The address provided is incorrect (N.P.A.I.: “Not Residing at Indicated Address”).
  • The package was not collected from the pickup point or post office within the given timeframe.
  • The Buyer refused customs clearance for international orders.

La Grourerie® is not responsible for returns under these conditions.

10.7 – Order cancellation by La Grourerie®:

We reserve the right to cancel an order in the following cases:

  • Suspected fraud after internal review.
  • Non-payment or ongoing dispute.

If La Grourerie® cancels the order, the Buyer will receive a refund within 14 days via the original payment method and will be notified by email.

 

ARTICLE 11 – CLAIMS:

Any claim must be reported within 48 hours following the receipt of the order via our contact form.

The claim must be accompanied by our withdrawal form, duly completed, and sent by email to the customer service.

11.1 – Required Information:

  • Order number.
  • Full name.
  • Product(s) concerned.
  • Detailed description of the claim.

11.2 – Processing Time:

A replacement or a solution will be proposed within 24 hours following receipt of the claim.

 

ARTICLE 12 – LEGAL WARRANTY OF CONFORMITY & HIDDEN DEFECTS:

12.1 – General Provisions:

La Grourerie® strives to ensure the conformity of its products and provides precise and complete information, in accordance with Article L111-1 of the Consumer Code.

Before any transaction, the Buyer is informed of the following elements:

  • The main characteristics of the products (nature, description, compatibility, etc.).
  • The total price including applicable taxes.
  • The estimated delivery time depending on the chosen carrier.
  • Information about legal and commercial warranties.
  • The possibility of using a consumer mediator in case of dispute.

12.2 – Legal Warranty of Conformity:

La Grourerie® is responsible for any lack of conformity of the Product under Article L217-4 of the Consumer Code, as well as for hidden defects under
Article 1641 of the Civil Code.

A product is considered compliant when:

  • It is suitable for its usual use.
  • It has the qualities presented in the model or sample.
  • It is delivered with its original accessories and packaging.
  • It meets the announced quality and safety standards.

If the Buyer invokes this warranty:

  • They have a 2-year period after receipt to act.
  • They may request repair or replacement under Article L217-12 of the Consumer Code.

12.3 – Warranty Against Hidden Defects:

The Buyer may invoke the warranty against hidden defects under Article 1641 of the Civil Code.

According to Article 1648 of the Civil Code :

  • The action must be taken within 2 years after discovering the defect.
  • The Buyer may request a cancellation of the sale or a price reduction.

12.4 – Contact for Warranty Claims:

Any warranty claim, whether regarding conformity or hidden defects, must be sent by email to service-client@lagrourerie.com.

 

ARTICLE 13 – PERSONAL DATA:

The collection of personal information in the context of distance selling is essential for the processing and delivery of orders, as well as for the issuance of invoices.

These details are strictly confidential and will not be shared with third parties, except when necessary for the execution of the order (e.g., carrier, payment service provider, etc.).

13.1 – Purpose of Data Processing:

The data collected is processed under the responsibility of La Grourerie® and is used for the following purposes:

  • Management and monitoring of orders, payments, and deliveries.
  • Communication of information regarding La Grourerie® offers and services, subject to the Buyer’s consent.

13.2 – Buyer’s Rights:

In accordance with the law “Informatique et Libertés” of January 6, 1978 (amended) and the General Data Protection Regulation (GDPR) No. 2016/679 of April 27, 2016, the Buyer has the following rights:

  • Right to access, rectify, and delete personal data.
  • Right to restrict data processing.
  • Right to object to data processing for legitimate reasons or for marketing purposes.
  • Right to data portability.

ARTICLE 14 – FORCE MAJEURE : (Unforeseeable Circumstance)

None of the Parties shall be held responsible for the total or partial non-performance of its obligations under these General Terms and Conditions of Sale (G.T.C.) if such failure results from an event of force majeure.

14.1 – Definition of Force Majeure:

Events considered as force majeure, in accordance with applicable law and French jurisprudence, include:

  • Natural disasters (storms, floods, earthquakes…)
  • Major strikes and social movements
  • Pandemics and health crises
  • Armed conflicts and war situations
  • Governmental decisions or imposed legislations
  • Any other unforeseeable and unavoidable event

14.2 – Notification and Actions Taken:

The Party invoking a force majeure event must inform the other Party within five (5) business days following the occurrence of the event. The Parties must then collaborate to determine appropriate measures to continue or modify the execution of the order during the affected period.

14.3 – Duration and Cancellation:

If the force majeure situation persists beyond one (1) month, either Party may cancel the order.

In case of cancellation, La Grourerie® commits to refunding the Buyer for any undelivered products.

 

ARTICLE 15 – APPLICABLE LAW AND DISPUTE RESOLUTION:

The contractual relations between La Grourerie® and its Buyers are governed by French law and legislation.

However, this choice does not deprive a Buyer residing in another European Union country of the mandatory and protective provisions applicable in their country of habitual residence, if La Grourerie® operates in that country or directs its activities there.

15.1 – Amicable Dispute Resolution:

In case of disagreement or dispute, the Buyer is encouraged to contact our Customer Service first to seek an amicable solution.

Requests can be sent via email.

We commit to handling each complaint with fairness and ensuring a quick and equitable resolution, always assuming good faith.

15.2 – Consumer Mediation Procedure:

In accordance with Article L.612-1 of the French Consumer Code, if negotiations with our Customer Service fail or if no response is received within 2 months, the Buyer may refer the matter to a consumer mediator free of charge for an amicable resolution.

La Grourerie® is a member of the CM2C Mediation Service (Centre de Médiation de la Consommation de Conciliateurs de Justice).

To contact the mediator, the Buyer may:

  • Submit their complaint online at: www.cm2c.net.

ARTICLE 16 – PARTIAL VALIDITY:

In the event that one or more provisions of these General Terms and Conditions of Sale are deemed invalid, unenforceable, or void under a law, regulation, or a final decision of a competent court, the remaining provisions shall remain fully in effect and continue to apply.
